Equipment Hire Terms & Conditions

These terms apply to all equipment hired from Dylan Proctor, ABN 15 355 801 065. By confirming a booking, paying for, collecting or taking possession of the equipment, the Hirer agrees to these terms.

1. Hire & Payment

The hire period begins when the Equipment is collected or delivered and ends when it is returned and inspected.

Unless otherwise agreed, hire fees must be paid before collection. Extensions must be approved before the agreed return time and are subject to availability and additional hire charges.

We may require photo identification, a security deposit or other reasonable security before releasing Equipment.

2. Your Responsibility

The Equipment is the Hirer's responsibility while in their possession.

The Hirer must take reasonable care of the Equipment, use it appropriately and protect it against damage, loss and theft.

The Hirer remains responsible where the Equipment is being used by their employees, contractors or production crew and must not sub-hire or loan the Equipment to another person or business without approval.

3. Damage, Loss & Theft

Equipment is supplied in good working condition. Any existing damage or faults should be reported when the Equipment is collected.

If Equipment is damaged during the hire, the Hirer is responsible for the reasonable cost of inspection and repair required to return it to its pre-hire condition. Reasonable cosmetic wear from normal, careful use is excluded.

If an item is lost, stolen or damaged beyond economical repair, the Hirer is responsible for the reasonable cost of replacing that item with the same model or, if unavailable, a reasonably equivalent replacement.

The approximate replacement value of the complete DZOFilm Vespid2 six-lens kit is $9,000 AUD. Damage to or loss of an individual lens does not automatically make the Hirer responsible for replacing the entire set.

Any loss, theft or significant damage must be reported to us immediately. Theft must also be reported to Police.

4. Care & Use

Lenses and optical equipment must be handled and cleaned appropriately. The Hirer is responsible for damage to lens elements, coatings, mounts, threads, mechanisms, electronics and other components occurring during the hire.

Equipment must not be dismantled, modified or repaired without approval.

Equipment must not be exposed to water, salt spray, sand, excessive dust, extreme temperatures or other conditions likely to cause damage.

Use on boats, beaches, drones, aircraft, vehicle rigs or in other unusually high-risk environments must be disclosed before hire.

5. Equipment Failure

If Equipment develops a fault that was not caused by the Hirer, contact us as soon as possible and stop using it where continued use could cause further damage.

Where appropriate, we may provide replacement Equipment, a refund or credit relating to the affected hire.

To the extent permitted by law, we are not responsible for consequential losses including production delays, reshoots, loss of footage, income or opportunity.

6. Return

Equipment must be returned by the agreed time, complete and in substantially the same condition in which it was supplied, allowing for reasonable wear.

Missing items, excessive cleaning or damage may be charged to the Hirer.

Late returns without prior approval may incur additional hire charges.

The Hirer's responsibility for the Equipment continues until it has been returned and we have had a reasonable opportunity to inspect it.

7. Cancellation

Unless otherwise agreed, cancellations made more than 48 hours before collection will not incur a fee.

Cancellations between 24 and 48 hours before collection may incur up to 50% of the Hire Price. Cancellations within 24 hours or failure to collect may incur up to 100% of the Hire Price.

8. General

All Equipment remains the property of Dylan Proctor at all times.

Nothing in these terms excludes any rights or guarantees that cannot lawfully be excluded under Australian Consumer Law.

These terms are governed by the laws of Tasmania, Australia.

By confirming a booking, paying the Hire Price or taking possession of the Equipment, the Hirer confirms they have read and accepted these Terms & Conditions.
